DPA and Legislation

The activities of the State Enterprise of the Ministry of Defence of Ukraine “Defense Procurement Agency” are regulated by the following laws and regulatory legal acts:

Law of Ukraine No. 808-IX of 17 July 2020 “On defense procurement”

This Law establishes the general legal principles of planning, the procedure for determining volumes, and specificities of conducting procurements of goods, works, and services of defense purpose to meet the needs of the security and defense sector, as well as other goods, works, and services for the guaranteed provision of security and defense needs. It also outlines the procedure for implementing state and democratic civilian oversight in the sphere of defense procurement.

Law of Ukraine No. 922-VIII of 25 December 2015 “On public acquisition”

It establishes and regulates the basis of acquisition of goods, execution of works, or provision of services required by territorial communities, state enterprises, or governmental institutions through the Prozorro public procurement system.

The Resolution of the Cabinet of Ministers of Ukraine No. 363 of March 03, 2021 “Certain issues pertaining to defense procurement”

By means of this Resolution, the following are endorsed:

  • The procedure for planning, formation, specificities of allocation, adjustment of defense procurements, the execution control, and reporting on their fulfillment, as well as the disclosure of information regarding defense procurements.
  • The process of conducting negotiations and executing a state contract (agreement) with a sole contractor.
  • Criteria and methodology for evaluating the most economically advantageous proposal of a participant in the procurement of goods, works, and services of defense purpose, in accordance with the requirements of the Law of Ukraine "On Defense Procurements".

The Resolution of the Cabinet of Ministers of Ukraine No. 1275 of November 11, 2022 “Certain issues pertaining to the conduct of defense procurement during the period of the legal regime of martial law”

By means of this Resolution, the following are endorsed specifics of conducting defense procurement during the period of the legal regime of martial law.

The Resolution of the Cabinet of Ministers of Ukraine No. 494 of May 16, 2023 “Some issues concerning the implementation of defense procurement by the state procurement service”

Regarding the approval of the procedure for the usage of funds allocated in the state budget for the procurement of defense-related goods, works, and services by the state enterprise of the Ministry of Defense of Ukraine, the “Defense Procurement Agency”.

The Resolution of the Cabinet of Ministers of Ukraine No. 710 of October 11, 2016 “Regarding the Effective Use of State Funds”

Measures for the efficient and judicious use of state funds allocated for the maintenance of government authorities and other state entities established by government authorities in enterprises, institutions, and organizations funded by the state budget.
